Contractors Professional Liability Insurance
(Design-Build / Contractors E&O)
Contractors professional liability insurance — also called Design-Build or Contractors Errors & Omissions (E&O) — protects Canadian contractors when a design error, professional mistake, or negligent act causes a client a financial loss. Design-build firms, engineering-led contractors, and construction managers now carry design responsibility, not just the means and methods of building, and those claims can fall outside a standard Commercial General Liability policy.
Stanhope Simpson places contractors professional liability insurance for design-build, EPC, and construction management firms across Canada — from our Atlantic Canada base — so defence costs and damages don’t stall your project or your balance sheet.
What Is Contractors Professional Liability Insurance (Contractors E&O)?
Contractors E&O is a professional liability contract between the insured contractor and the insurer. It responds to third-party claims arising from an actual or alleged negligent act, error, or omission committed in the performance of professional services — such as design, engineering, project management, or consulting — subject to the policy’s definitions, exclusions, and reporting requirements.
In Canada, contractors professional liability insurance is especially relevant for design-build and integrated project delivery, where the contractor assumes design responsibility that a traditional builder would not. It is the construction-specific form of errors & omissions (E&O) insurance. Coverage varies by insurer and program design, but a Contractors E&O policy commonly responds to:
- Defence and legal costs to investigate and respond to a covered claim, including expert and consultant fees (within policy terms).
- Damages the contractor becomes legally liable to pay for a covered design error, professional negligence, or omission.
- Rectification or mitigation costs to correct or limit the impact of a covered error, when included by the policy wording and subject to conditions and sublimits.
Important: Contractors E&O is typically written on a claims-made basis, meaning the claim must be both made and reported while the policy is in force. Policies carry a deductible and defined limits, and exclude items such as known prior claims, guaranteed cost estimates, express warranties or “fitness for purpose” guarantees, and the bodily injury or property damage insured under a Commercial General Liability (CGL) policy.

Contractors E&O Program Features
Design Error Coverage
Contractors professional liability insurance responds to claims alleging a negligent design error or omission in the professional services you deliver on a design-build or engineer-of-record basis.
Defence Cost Coverage
Pays the cost of investigating and defending a covered claim — including legal counsel and expert witnesses — which can be significant even when a claim is ultimately without merit.
Contractual Liability Coverage
Extends to professional obligations you assume under design-build and integrated project delivery contracts, where you carry design responsibility beyond traditional construction means and methods.
Rectification / Mitigation Coverage
Helps cover the cost to correct or limit the impact of a covered design error before it escalates into a larger loss, when included by the policy wording.
Sub-Consultant Coverage
Protects you against exposure arising from the errors of the architects, engineers, and design sub-consultants you retain and remain responsible for.
Project-Specific or Practice Coverage
Available as an annual practice policy covering all your work, or as project-specific coverage for a single large or high-risk design-build project.
Why Would I Need Contractors E&O?
Design-Build Responsibility
On design-build and Engineering, Procurement, and Construction (EPC) projects, you take on design liability a traditional contractor never carried — an exposure that a standard CGL policy is not built to cover.
Contract Requirements
Many Canadian owners, public agencies, and lenders now require design-build contractors to carry professional liability insurance before a contract is awarded.
Gaps in CGL Coverage
Commercial General Liability responds to bodily injury and property damage — not to the purely financial loss caused by a professional error or faulty design. Contractors professional liability insurance fills that gap.
Cost of Defending Claims
Even a groundless allegation of professional negligence can cost significant sums to defend. E&O funds your defence so a single dispute doesn’t threaten the firm.
Who Needs Contractors Professional Liability Insurance?
If a contract makes your firm responsible for design — in whole or in part — you carry a professional liability exposure that a construction policy will not answer. Across Canada, contractors professional liability insurance is typically required, or strongly recommended, for:
- Design-build general contractors and construction managers who hold the design contract.
- EPC and industrial contractors delivering engineering, procurement, and construction under one agreement.
- Mechanical, electrical, HVAC, fire protection, and sprinkler contractors carrying delegated design.
- Structural steel, precast, curtain wall, and building envelope subtrades that seal shop drawings.
- Civil, utility, and infrastructure contractors bidding P3 and progressive design-build projects.
- Renewable energy, modular, and prefabricated builders whose systems are engineered in-house.
- Contractors selling consulting, commissioning, feasibility, scheduling, or estimating services for a fee.
Subcontracting the design does not remove the exposure. Your firm stays contractually responsible to the owner for the architects and engineers you retain — and a sub-consultant’s claims-made policy may no longer exist by the time a defect surfaces.
Typical Limits & Canadian Contract Requirements
Insurance requirements are set by the project agreement, not by the insurer. Under a CCDC 14 design-build contract, Canadian owners commonly ask the design-builder to provide:
- Professional liability of not less than $1,000,000 per claim for the design-builder and its consultant.
- At least $250,000 per claim for sub-consultants and other retained design professionals.
- Higher limits — commonly $2,000,000 to $10,000,000 — on large institutional, P3, and infrastructure projects.
- Written confirmation that the consultant’s policy carries no “design-build exclusion.”
- Coverage held continuously from commencement of the work, plus an extended reporting period afterward.
- Certificates of insurance for the owner and 30 days’ notice of cancellation or material change.
Professional liability responds to negligence — a failure to meet the standard of care. It does not insure a guarantee, warranty, or “fitness for purpose” obligation you accept in a contract. We review your CCDC 14, CCDC 30 (Integrated Project Delivery), and P3 project agreements before you sign, so uninsurable wording is flagged while it can still be negotiated.
Contractors E&O vs. CGL vs. Surety Bonds
Contractors E&O (Professional Liability)
Contractors professional liability insurance covers the financial loss a client suffers because of a negligent design error, omission, or professional service failure. It pays defence costs and damages on a claims-made basis.
Commercial General Liability (CGL)
Responds to third-party bodily injury and property damage arising from your operations. It specifically excludes liability arising out of professional services — the gap Contractors E&O fills.
Surety Bonds
A guarantee to the project owner that you will perform the contract and pay your labour and material suppliers. Bonds protect the owner, not your firm, and any loss paid is indemnified back to you.
Benefits of Contractors E&O
Comprehensive Protection
Contractors professional liability insurance covers both the damages you may owe and the cost of defending a covered claim, protecting your balance sheet from professional liability exposure.
Competitive Advantage
Carrying contractors professional liability insurance lets you qualify to bid design-build, P3, and integrated delivery projects that require proof of professional liability coverage.
Financial Stability
Safeguards your firm’s profitability and reputation by transferring the financial impact of a covered design error to your insurer.
Contractors Professional Liability Insurance FAQs
A Commercial General Liability (CGL) policy responds to bodily injury and property damage caused by your operations. Contractors professional liability insurance responds to the purely financial loss caused by a professional error, omission, or negligent design decision — exposures a CGL policy specifically excludes. Most Canadian design-build firms carry both.
A surety bond guarantees your performance or payment obligations to a project owner and is not insurance for your own losses. Contractors E&O is a professional liability insurance policy that pays your defence costs and any damages you owe for a covered professional error. They serve different purposes and are often required together.
Design-build contractors, EPC firms, construction managers, and any contractor who assumes design responsibility or provides professional services such as engineering, project management, or consulting. It is increasingly required on public and private projects across Canada.
Coverage commonly includes legal defence costs, expert and consultant fees, and damages the contractor is legally liable to pay for a covered negligent act, error, or omission. Some policies also respond to rectification or mitigation costs, subject to policy terms, conditions, and sublimits.
Yes. Contractors E&O policies carry a deductible that applies to each claim, and defined policy limits (per claim and in the aggregate). The retention and limits are set based on the size and risk profile of your firm and its projects.
Premiums are based on factors such as annual revenue, the type and value of projects, the share of design-build work, your claims history, sub-consultant use, and the limits and deductible selected.
Contractors E&O is typically written on a claims-made basis: the policy must be in force both when the work is performed and when the claim is made and reported. Maintaining continuous coverage — and a retroactive date that reaches back to your earlier projects — is important to avoid gaps.
Many policies extend to claims arising from the work of the architects, engineers, and design sub-consultants you retain and remain responsible for. It is also good practice to confirm that your sub-consultants carry their own professional liability coverage.
Yes. Coverage can be written as an annual practice policy covering all your work, or as project-specific insurance for a single large, complex, or high-risk design-build project. Your broker can advise which structure fits the engagement.
Notify Stanhope Simpson or insurer as soon as you become aware of a claim or a circumstance that could lead to one — prompt reporting is a condition of most claims-made policies. Preserve project records and avoid admitting liability, and your insurer will guide the defence.
